Nuo 2017 m. liepos mėn. viršvalandinius darbus darbdavys gali nurodyti dirbti tik darbuotojui sutikus, išskyrus:
kai darbai yra būtini ar siekiama užkirsti kelią pavojams, avarijoms, nelaimėms ar skubiai likviduoti ;
būtina užbaigti darbą ar pašalti gedimą dėl kurių didelis darbuotojų skaičius turėtų nutraukti darbą ar sugestų medžiagas, produktai ar įrenginiai;
tai numatyta kolektyvinėje sutartyje.
Viršvalandinių darbų trukmės apribojimai:
Per septynių paeiliui einančius kalendorinių dienų laikotarpį negali būti dirbdama ilgiau kaip 8 valandas viršvalandžių;
Negalima dirbti 48 valandų per savaitę, skaičiuojant per ataskaitinį laikotarpį;
Viršvalandžių trukmė per metus -180 valandų.
SVARBU. Įsigaliojus naujam Darbo kodeksui, kai taikoma suminė darbo laiko apskaita, viršytas darbo laikas bus nustatomas tik apskaitinio laikotarpio pabaigoje.
